Federal Court Orders Freedom of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without legal authority.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling charges, he was held in immigration custody.
In her decision, the judge pointed out that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
Context of the Legal Challenge
The legal proceedings involve disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing criminal case in the state of Tennessee.
